Any individual whose land or property is being acquired by the government is entitled to compensation. As per Proposition 207, this compensation can be of two forms; cash compensation or property substitution. Whenever the government takes a property from its owner, it must allocate that individual with a similar substitute for his/her property. That property must be safe and hygienic. The owner can also opt for cash compensation. It all depends on the individual! Proposition 207 also states that an individual is entitled to compensation only if the value of his/her property is reduced due ‘the land use law’. This law governs the use of land. The Proposition 207 defines seven different types of ‘land use laws’ that are exempted from the requirement of compensation.

The government holds the right to revoke the ownership of any real estate for the purpose of public use. But as far as the state of Arizona is concerned, Proposition 207 prevents that. Well in a way, it does prevent that but for the good of the citizens. Government has defined a ‘prominent sphere of influence’ which gives government the right to take any property for public use. In such a case, Proposition 207 highlights the constitutional rights of the owner.  The Proposition 207 restricts the use of this ‘prominent sphere of influence’ when it is authorized by the government in order to take any property for public use. According to Proposition 207, the term ‘public use’ is defined as; use of the property by the common public only, use of land for public service, use of land in order to destroy the property threatening public safety and health and finally acquiring land which has been abandoned.
